Good luck with dealing with this issue. And since you and your husband are both attorneys you might want to start researching your policy's and other options to help do some arm twisting. And you're going to hate it, believe me, the last time I did this I was getting paid for it and I still hated it.<br /><br />Check your policy so you know what the disclaimers are. This will take hours but you can use it to amuse yourself as you wait for your kids to get out of your bathroom. That way when they come back with the 'it's not covered' statement, you are in a position to respond. “And just where in the docs is that stated because that's not how I read it'.<br /><br />After that there will be an annoying internal appeal process. Again see policy. It will be arcane and heavily weighted against both intuition and everything you know about civil procedure. Document *everything*. Point out early in the process that both you and KH have law degrees. In fact point this out often. If you get lucky somebody in the insurance company's legal department will decide that it's cheaper to pay you than respond to you. <br /><br />If all else fails, be sure the contractor you hire to actually fix the thing will be a good witness and file a, hopefully, small claims court action. The reason insurance companies get away with this sort of thing is most people give up rather than fight over it, so think of it as pro bono work.Anonymousnoreply@blogger.com
